1. About Our Service

Johnson Family Towing, LLC, doing business as "Last Resort Transport" ("the Company," "we," "us," or "our"), is a transportation service based in Lincoln County, Washington. We provide two main services:

  • Passenger Service: Door-to-door transportation with one-way or round-trip options.
  • Grocery Delivery: Grocery pickup and delivery service.

2. Service Hours and Pricing

  • Regular Hours: Monday-Friday 9:00 AM - 6:00 PM.
  • After-Hours Service: Available 6:00 AM - 10:00 PM at premium rates.
  • Weekend Service: Saturday and Sunday service available at premium rates.
  • Pricing Structure: Pricing is based on service type, distance, passenger count, and time of service. Detailed quotes will be provided during the booking process.
  • Wait Time Inclusions:
    • Round-trip passenger service includes 1 hour waittime.
    • Grocery delivery includes 15 minute wait time.
    • Extended wait time subject to additional charges.
  • Final Pricing: Final pricing may vary from initial estimates based on actual distance, service requirements, and any additional services requested.

3. Booking, Payment, and Cancellation Policy

  • Booking Requirements: All services require at least 2 hours advance notice.
  • Last-Minute Service: Last-minute service may be available, please call (509) 204-4311 for availability. Premium rates may apply.
  • Booking and Payment Process: Initial booking requests are acknowledged via phone, email, or text message. You will receive a secure payment link via text or email after we confirm your service details. Your booking is reserved upon successful payment.
  • Payment Methods: We accept all major credit and debit cards, Apple Pay, and ACH bank payments. Cash is NOT accepted.
  • Changes and Cancellations: Changes or cancellations must be made at least 1 hour before scheduled pickup time and are subject to availability. Late cancellations may result in charges.
  • No Refund Policy: There is no entitlement to a refund once the Company has dispatched for service. Failure to be present at pickup results in full charges with no refund.
  • Pricing and Disputes: Pricing adjustments are at the Company's sole discretion. Any pricing disputes must be raised within 24 hours of service completion.

4. Service Limitations

  • Passenger Capacity: Maximum 6 passengers per trip.
  • Luggage: Limited to 1-2 modest bags per passenger or several grocery bags (moderate cart full).
  • Grocery Orders: Limited to moderate grocery orders that fit in a standard shopping cart.
  • Service Area: Our primary serivce area is Lincoln County, WA. Service to areas outside Lincoln County, WA is subject to availability.
  • Weather: Service may be suspended during severe weather conditions for safety reasons.
  • Vehicle Requirements: All passengers must be able to enter and exit our vehicles without assistance.

5. Customer Responsibilities

  • Accurate Information: Provide accurate pickup and destination addresses and contact information.
  • Punctuality: Be ready at pickup time. We will wait up to 5 minutes before departing.
  • Grocery Orders: For grocery delivery, have your order ready for pickup at the store at the designated time.
  • Appropriate Behavior: Maintain respectful behavior toward our drivers and other passengers.
  • Property: You are responsible for your personal belongings during transport.
  • Special Needs: Inform us of any special accessibility requirements when booking.

6. Force Majeure and Limitation of Liability

  • Force Majeure: The Company shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, traffic, inclement weather, road closures, acts of government, acts of God, acts of war, fire, insurrection, strikes, riots, or other acts of nature.
  • Limitation of Liability: Agreement to these terms acknowledges that the Company will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, property, goods or services, irrespective of whether or not such loss or damage has been advised or otherwise anticipated.
  • Personal Property: We are not responsible for lost, stolen, or damaged personal property.
  • Medical Conditions: Passengers with medical conditions travel at their own risk. We do NOT provide urgent or emergency medical transport, or transport passengers with active medical emergencies.

7. Privacy Policy

  • Information Collection: We collect only necessary information to provide our services (name, phone, email, pickup/destination addresses, etc.).
  • Information Use: Your information is used solely for service, delivery, billing, and communication purposes.
  • Information Sharing: We do not sell or share your personal information with third parties.
  • Data Retention: Information is retained for business and tax purposes.

8. Service Guarantee

  • No Guarantee: Agreement to these terms acknowledges that the Company cannot guarantee the results or effectiveness of any of the transportation services rendered or to be rendered.
  • Professional Service: Transportation services shall be executed in a professional manner and in accordance with good industry practice.
  • Best Efforts: Best efforts will be used but no specific results, timing, or outcomes are promised.

9. General Terms and Agreement

  • Service Authorization: Providing payment, signature, or authorization for service by phone, text, email, or online booking system constitutes agreement to these terms and certifies legal authorization to request transportation services.
  • Agreement Modifications: This agreement shall not be changed, modified, terminated, or discharged, in whole or in part, except by an instrument in writing signed by both parties hereto, or their respective successors or assignees.
  • Service Provider: All transportation services are provided by Johnson Family Towing, LLC, doing business as Last Resort Transport.
  • Governing Law: These terms are governed by the laws of Washington State.
  • Jurisdiction: Any disputes will be resolved in Lincoln County, Washington.
  • Severability: If any part of these terms is invalid, the remaining terms remain in full force and effect.
  • Entire Agreement: These terms constitute the complete agreement between customer and the Company for transportation services.
